Welcome to TruState. These Terms of Service ("Terms") govern your use of the TruState website, applications, and services (collectively, the "Platform"). By using the Platform, you agree to these Terms.

1. Professional Services Disclaimer

TruState is a Software-as-a-Service (SaaS) technology platform. TruState is NOT a registered real estate dealer, broker, auctioneer, developer, architect, or legal advisor under the laws of Jamaica. We do not represent users in property transactions, nor do we provide legal, financial, or valuation advice. All property transactions facilitated through the infrastructure provided by TruState must be conducted in compliance with the Real Estate (Dealers and Developers) Act and other relevant local regulations.

2. Use of the Platform

You must be at least 18 years old to use the Platform. You agree to provide accurate and complete information when creating an account and to keep this information up to date. You are responsible for all activity that occurs under your account.

3. User Conduct

You agree not to:

  • Use the Platform for any illegal purpose or in violation of any local, national, or international law, including the laws of Jamaica.
  • Submit false, inaccurate, or misleading information.
  • Infringe upon the rights of others, including intellectual property rights.
  • Engage in any activity that could disrupt, damage, or impair the Platform.

4. Property Listings and Transactions

Sellers, landlords, and their authorized agents are solely responsible for the accuracy of their property listings. TruState provides the digital infrastructure to facilitate these listings and transactions but is not a party to any agreement between users. We do not own, inspect, or endorse any properties listed on the Platform. All bids and applications are binding agreements between users, not between a user and TruState.

5. AI-Powered Tools

The Platform provides AI-powered tools such as property valuation and tenant matching for informational and assistive purposes only. These tools are based on data and algorithms and do not constitute formal valuations by a licensed surveyor or legal advice by an attorney. Users are explicitly advised to consult with licensed professionals before finalizing any high-value transaction.

6. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without any warranties of any kind. We do not warrant that the Platform will be uninterrupted, secure, or error-free.

7. Limitation of Liability

To the fullest extent permitted by applicable law, TruState shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of our facilitation services.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to its conflict of law principles.
